April 2020: Company & Union File Another Round of Appeals on Union Election

On April 2, Kumho filed another appeal on the union election.

This time, they requested that the full National Labor Relations Board review parts of the Regional Director’s decision from March 6th. The USW also requested review of some parts to make sure our case stands strong.

Both the USW and Kumho will be able to respond and likely file oppositions, similar to what we filed in the last appeal.

The next step will be finding out if the National Board will choose to review the case.

They could choose to review all of it, some of it or none of it. If they don’t want to review it, then the current decision is final and they could count the ballots. If they do choose to review, then we will have to make our case again and wait on their final decision.

We keep fighting because we believe union supporters won this election, and we want workers to have a say in their working conditions, health and safety, schedules and pay.

Unfortunately, the company is using highly paid lawyers to try to slow us down with even more delay tactics.

But we know, now more than ever, that we need to stand together in support of a union at Kumho.

The current health crisis shows how important it is for workers to have a voice and representation. If you have questions about your pay or eligibility for federal and state benefits related to the corona virus, please contact us.
